Trump Seeks High Court Clearance for State Guard Personnel in Chicago Area
On Friday, the White House petitioned urgently to the federal top court, asking for approval to deploy national guard forces to the state of Illinois.
This move is part of a broader campaign to expand the domestic use of the troops in multiple cities run by Democrats.
Court Fight Over Troop Deployment
In an immediate request, the justice department urged the judiciary to set aside a previous judicial decision that had stopped the stationing of a few hundred military reserve members to the Chicago region.
The district judge had raised doubts about the government's explanation for activating the guard, challenging its reasoning in considering regional circumstances.
A higher court supported the initial ruling on the previous day, leaving the deployment on standby while the court case continues.
White House's Justifications
The federal legal representative, speaking on behalf of the White House, wrote in the latest petition that federal law enforcement have often been “threatened and assaulted” in Chicago and the neighboring town of Broadview.
This area is home to an ICE detention center.
The commander-in-chief has earlier sent national guard personnel to Chicago and the city of Portland, after previous deployments to LA, the city of Memphis, and the nation's capital.
The administration has argued that troop deployment is necessary to curb unrest and bolster border control.
Partisan Pushback
Democratic officials have vehemently criticized the move, saying that the president’s claims are greatly exaggerated and partisan in nature.
They allege the president of abusing his authority to target political rivals.
Court officials have also expressed doubt about the government's portrayal of ongoing incidents.
Regional authorities state that demonstrations over immigration enforcement have been mostly modest and calm, contrasting with the president’s portrayal of “battlefield” conditions.
Legal Basis
At the center of the dispute is the president’s use of a US code permitting the president to federalize the military reserve only in cases of uprising or when “unable with the regular forces to enforce the laws of the United States”.
The government maintains that the forces are required to defend US facilities and agents from protesters.
Latest Actions
Previously, the administration nationalized several hundred personnel of the state guard of Illinois and directed more Texas-based troops into the Illinois.
As state authorities denounced the action, the former president escalated his rhetoric, urging the detention of the mayor of Chicago and the governor of Illinois, the two Democratic officials, charging them of failing to secure federal agents.
The state of Illinois and municipal government together took legal action against the government to stop the sending.
On the ninth of October, district Judge April Perry, nominated by President Biden, handed down a preliminary order blocking the directive.

Simultaneously in the city, at least a dozen people were taken into custody outside the Broadview Ice detention center following serious disputes between local police and protesters.
